The Legal Department of Mira Bhayandar Municipal Corporation (MBMC) is responsible for handling all legal matters, civil suits, and court cases filed against the corporation in various courts.

Jurisdiction & Legal Proceedings

📌 The department manages cases in the following courts:

  • Hon'ble Civil Court, Thane
  • Hon'ble Industrial Court, Thane
  • Consumer Grievance Redressal Court, Thane
  • Hon'ble High Court, Mumbai
  • Hon'ble Supreme Court, Delhi

📌 The Legal Department represents the Municipal Corporation in writ petitions, civil suits, and other legal disputes.

Establishment of the Legal Department

📌 The independent Legal Department was officially established in the year 2005 to handle legal matters efficiently and ensure compliance with legal provisions.

 

Nature of work, duties and responsibilities in the Legal Department : -

·       To record the claims filed against Mira Bhayandar Municipal Corporation in the Claims Register .

·       Appointing prosecutors from the Municipal Prosecutors Panel in the said claim according to rotation or according to the attached survey number and sending the said claim to the prosecutors for judicial proceedings .

·       Providing information about the claims received to the relevant department and requesting information from the claim .

·       Providing the information received in the claim from the relevant department to the relevant prosecutors for filing a written statement .

·       Check the draft of the written statement received and send it to the concerned department for further examination and signing .

·       Filing of records in the Legal Department .

·       The orders received by the Municipal Corporation in the relevant claim shall be communicated to the relevant department for action .

·       To follow up on claims filed against / through the Municipal Corporation .

·       Payment of fees for work done by prosecutors on the Municipal Corporation's panel .

·       As informed by the concerned department , Hon'ble Municipal Corporation Prosecutor to file a caveat in the court .

·       Updating the computer command system of the Legal Department .

·       Filing an appeal against an order passed against the Municipal Corporation .

·       Giving opinions to various sections .

·       Under Section 1949 of the Maharashtra Municipal Corporation Act , action will be taken to prepare rules , bye-laws and standing orders as per the recommendations of the Hon'ble Commissioner .

Notable achievements in the year 2023-2024 : -

·       To facilitate the smooth functioning of the Legal Department , a computerized order system has been developed in thLegalDepartment and the records of the claims filed against the Municipal Corporation in the Civil Court , Thane from the year 2000 to the present are being updated . The said order system has also been published on the website of the Municipal Corporation www.mbmcrti.com .

·       Cases that were brought to court regarding some important works in the planned development plan of the Municipal Corporation have been settled in favor of the Municipal Corporation . 

·       Regarding unauthorized constructions in the Mira Bhayandar Municipal Corporation area , the Hon'ble Court has ruled in favor of the Municipal Corporation in the claims and the concerned department has been informed to take action against most of the unauthorized constructions .

·       In many of the suits filed against the Municipal Corporation, written statements were not filed due to the information being provided to the Municipal Prosecutor in time. In the pending suit , written statements have been filed after seeking information from the concerned department .

·       The record of bills paid to the prosecutors on the Mira Bhayandar Municipal Corporation panel is being updated on the website of the Legal Department .

·       Most of the claims have been settled by filing an undertaking to take legal action through the Municipal Corporation regarding unauthorized construction and demolishing the construction . The claims have been settled by applying to the Hon'ble Court .

·       In the year 2023-24 , 60 claims have been settled in favor of the Municipal Corporation in the cases pending before the Hon'ble Civil Court , Thane .

·       In the year 2023-24 , the Hon'ble High Court of Mumbai has disposed of 25 petitions / appeals in favor of the Municipal Corporation in the jurisdictional cases .
