To curb encroachments and unauthorized construction in the Mira Bhayandar Municipal Corporation (MBMC) area, the following procedures
and responsibilities have been established:
Ward Committees & Enforcement Teams
A total of six ward committees have been established within the MBMC jurisdiction.
Each ward committee is headed by a Sixth Commissioner who is responsible for overseeing encroachment and unauthorized construction control.
An Enforcement Team has been formed at the ward level, consisting of a Junior Engineer and laborers under the supervision
of the respective Sixth Commissioner.
The responsibility for taking action against encroachments and unauthorized constructions within each ward lies with the
concerned Sixth Commissioner.
Appointment of Beat Inspectors
As per Government Circular No. S.K.P.A./2008/P.R.No.05/2008/Navi-23, dated 28/02/2008, and Commissioner’s Office Order No
. Manpa/Commissioner/05/2008-09, dated 01/04/2008, a total of 38 clerks from the Tax Department have been appointed as Beat Inspectors.
Beat Inspectors are responsible for monitoring unauthorized construction and encroachments. They submit a written report to
the Sixth Commissioner, with a copy forwarded to the Chief Executive for further action.
Legal Authority & Action Procedures
All Sixth Commissioners have been designated as Authorized Officers under:
Sections 260(1)(c), 261, 264, 267, and 478 of the Maharashtra Municipal Corporation Act, 1949.
Sections 52, 53, 54, and 55 of the Maharashtra Regional and Town Planning Act, 1966.
If the Sixth Commissioner, upon reviewing records, finds unauthorized construction, appropriate legal notices
are issued under Section 260 of the Maharashtra Municipal Corporation Act, 1949.
Further action is taken in accordance with the prescribed rules by the Sixth Commissioner and the Designated Officer.
Activities in the Encroachment Department:-

1. In each ward of Mira Bhayandar Municipal Corporation area , an unauthorized construction / encroachment control / elimination team has been established at
the ward level . Each six . A team consisting of a junior engineer and laborer has been formed under the Commissioner . Action against encroachment and
unauthorized constructions taking place within the ward is taken through the concerned six . Commissioner .
2.In accordance with the complaints received at the Mira Bhayandar Municipal Corporation head office regarding unauthorized constructions , encroachments , hawkers , hoardings , posters , banners , mobile towers, to inform the
concerned Sixth Commissioner and designated officer to take appropriate action on the said complaint . And while taking the said action , to be present as the Head of the Department during the campaign along with the Sixth Commissioner and designated officer .
3. To review the action taken on the notices issued by the concerned ward Six Commissioners against unauthorized constructions under the M. R. T. P and as per the provisions of the Maharashtra Act .
4. To coordinate with the police forces provided for the encroachment department .
5. Submitting the report received from the designated officer of the Commissioner regarding the action taken regarding encroachment and unauthorized construction to the Deputy Commissioner .
6. The campaigns carried out by the encroachment department and if police cases have been registered , their publicity should be published on the website of the Municipal Corporation of Maharashtra through the Sixth Commissioner of the concerned ward .
7. Transfer the Right to Information application to the concerned Ward Committee office , take action on the application and inform the applicant about the information being provided .
Starred / unstarred questions and resolution notices received from the government . To collect information from all the concerned ward committee offices on the question and submit it to the government .
